How does bail work in Queensland?

When charged with an offence, you will either be kept in custody (remand) or released on Bail until your trial. Bail is essentially a contract where you promise to attend court in exchange for your freedom.

Types of Bail

  1. Watchhouse Bail: Granted by the police at the station shortly after arrest.
  2. Court Bail: If police refuse bail, you must be brought before a Magistrate (usually within 24 hours) to apply for Court Bail.

Will I Get Bail?

For most offences, there is a presumption in favour of granting bail.1 The police must prove why you should not be released. They might argue you are an “unacceptable risk” because:

  • You might fail to appear (flight risk).
  • You might re-offend.
  • You might endanger public safety or interfere with witnesses.

“Show Cause” Situations

If you are in a “Show Cause” position (e.g., you allegedly committed a crime while already on bail, or are charged with a serious violent offence), the tables turn: You must prove why your detention is not justified.2 This is much harder and requires a skilled lawyer.

Bail Conditions

To mitigate risk, the Court may impose conditions:

  • Reporting: Signing in at a police station (e.g., every Monday/Friday).
  • Curfew: Being home between 8pm and 6am.
  • Residential: Living at a specific address.
  • No Contact: Not contacting victims or witnesses.

Breaching Bail

If you breach a condition (e.g., miss a reporting day), you commit a distinct criminal offence called “Breach of Bail.” This often results in your bail being revoked and you being remanded in custody until your trial.

Urgent Bail Applications

You usually only get one shot at a bail application in the Magistrates Court. If refused, you must go to the Supreme Court (which is expensive). It is critical to get it right the first time.
