How do I apply for a Domestic Violence Order?
ProcessTo get protection, you must bring the matter before a Magistrate.
1. Police Application
If police attend an incident, they may issue a Police Protection Notice (PPN) immediately. This acts as a temporary DVO. They will then file an application in court on your behalf. This is the strongest route as the police prosecutors handle the case.
2. Private Application (Form DV01)
If police do not act, you can apply yourself.
- Step 1: Download and complete Form DV01 from the Courts website.
- Step 2: Detail the incidents (What happened? When? Were you afraid?).
- Step 3: File it at your local Magistrates Court.
- Step 4: The police will serve the application on the Respondent (the other person).
- Step 5: Attend the first court date (“The Mention”).
The Criteria
To grant an order, the Magistrate must be satisfied of three things:1
- A relevant relationship exists (couple, family, or carer).
- Domestic violence has occurred.
- The order is necessary or desirable for your protection.
