The cost of a family law matter is the biggest concern for most clients. At Bell & Senior, we believe in radical transparency about fees so you can make informed decisions.

Fixed Fees vs Hourly Rates

Depending on the nature of your case, we work on two main billing models.

1. Fixed Fees (Uncontested Matters)

For work where the scope is clearly defined, we can offer a fixed price. This gives you certainty.

  • Divorce Application: Fixed professional fee (plus filing costs).
  • Consent Orders: If you have reached an agreement, we can draft and file the orders for a fixed sum (typically between $2,500 – $4,500 depending on complexity).
  • Binding Financial Agreements: Fixed drafting fees available.

2. Hourly Rates (Contested Matters)

If your matter involves negotiation, mediation, or court proceedings, it is impossible to predict exactly how many hours it will take (as it depends on how unreasonable the other side is).

  • We charge in 6-minute units according to a Costs Agreement you sign upfront.
  • We provide interim billing (usually monthly) so you never get a shock at the end.
  • We provide detailed estimates before each stage (e.g., “The preparation for mediation will likely cost between $X and $Y”).

Who Pays the Costs?

In Australian Family Law, the general rule is that each party pays their own legal costs, regardless of who “wins.”1

Exceptions exist where the Court may order one party to pay the other’s costs, but this is rare and usually reserved for conduct that unnecessarily drives up costs (e.g., refusing a reasonable settlement offer or failing to disclose documents).2

  1. Be Organised: Present your financial documents in neat folders with clear labels. If we have to sort through a shoebox of crumpled receipts, that is expensive administrative time.
  2. Communicate Efficiently: Save up non-urgent questions for one email or call, rather than sending 5 emails a day.
  3. Compromise: Fighting over small items (like furniture) often costs more in legal fees than the item is worth. Focus on the big picture (House, Super, Kids).
