Can I change lawyers if I'm unhappy with my current firm?
Client RightsClients often feel “trapped” with their current lawyer, especially if a case has been going on for months. However, the law in Queensland is clear: you are the client, and you have the right to terminate your relationship with a law firm at any time.
1. Why Clients Switch
Common reasons for changing firms include:
- Poor Communication: Phone calls not returned or being kept in the dark.
- High Fees: Billing that exceeds the initial estimate without explanation.
- Lack of Progress: Feeling like the case is stalling.
- Loss of Trust: Disagreeing with the strategy or feeling pressured to settle.
2. The Process of Switching
Switching is surprisingly simple for the client. You do not even have to tell your old lawyer yourself if you don’t want to.
- Engage New Firm: You meet with a new firm (like Bell & Senior) and sign a “Letter of Authority”.
- File Request: We send that letter to your old firm requesting the transfer of your physical and digital files.
- The Transfer: The old firm prepares the file and sends it to us (usually within 7-14 days).
3. The “Solicitor’s Lien” (Fees)
Your old lawyer has a right to be paid for the work they have already done.
- If you have paid all your bills, they must release the file immediately.
- If you have outstanding bills, they may claim a “Solicitor’s Lien”, meaning they keep the file until you pay.
- The Solution: In many cases, we can negotiate a “Tripartite Agreement” where your old firm releases the file, and we guarantee their fees will be paid from the final settlement or at the end of the case.
4. Will it Delay My Case?
