Why can't you give me a cost estimate over the phone?
BillingWe often receive calls asking: “How much for a divorce?” or “What do you charge for a lease?”. While we understand you need to budget, giving a “ballpark” figure without knowing the facts is one of the most common causes of client-lawyer disputes.
1. The Variable Nature of Law
Unlike a fixed product (like a car), legal services are a process. The final cost is determined by:
- The Other Side: We might be reasonable, but if the other party is aggressive or refuses to disclose documents, the work required triples overnight.
- Hidden Complexity: A “simple” contract often has 20 years of history or complex tax implications that only become visible once we read the fine print.
- Court Requirements: If a matter moves from negotiation into Court, the procedural requirements are set by the judge, not the lawyer.
2. Our Professional Responsibility
As legal practitioners in Queensland, we are required by law to provide you with a Costs Agreement and a Disclosure Notice.1
- This must be an accurate estimate based on the actual work we expect to do.
- Giving a “cheap” quote over the phone simply to get you through the door, only to double it later, is unethical.
3. The Value of the Consultation
Our initial strategy consultation is not just a “meet and greet.” It is a value-heavy session where we:
- Map the Facts: Understand exactly what has happened.
- Identify Risks: Find the “landmines” in your case before they explode.
- Create a Strategy: Decide if you even need a lawyer (sometimes you don’t!).
- Define the Scope: Only then can we say: “Stage 1 will cost $X and Stage 2 will cost $Y.”
4. Fixed Price Options
