How do I protect my business intellectual property (IP)?

1. Trademarks (Brand)
To protect your business name, logo, or slogan, you must register it as a Trademark with IP Australia.
- Myth: “Registering a business name protects me.” False. A business name/ASIC registration gives you NO proprietary rights. Only a trademark gives you the exclusive right to use the brand.1
2. Copyright (Content)
Copyright protects original expression (e.g., software code, website text, manuals).
- Automatic: In Australia, copyright is automatic upon creation. You don’t need to register it.
- Ownership: Ensure your employment contracts state that the company owns all code/content created by employees.
3. Confidential Information (Secrets)
Customer lists, pricing strategies, and algorithms are often protected as “Trade Secrets.”
- NDA: Use Non-Disclosure Agreements (NDAs) before sharing secrets with partners.
