How long does it take to get Probate in Queensland?
ProbateProbate is the first major milestone in administering a deceased estate. While every case is unique, the Supreme Court of Queensland follows a strict statutory timeline.
1. The Statutory Wait (14 Days)
Before an application can even be filed, you must advertise your intention to apply in the Queensland Law Reporter (QLR).
- Purpose: This gives creditors or anyone holding a later Will 14 days to come forward.
- The Clock: You cannot file the court documents until at least 15 days after the advertisement appears.
2. Document Preparation (1-2 Weeks)
While the 14-day clock is ticking, your lawyer will draft the:
- Application for Grant: The formal request to the Court.
- Affidavit of Executor: A sworn statement by you confirming the details of the death and the Will.
- Affidavit of Publication: Proving the advertisement was correctly placed. Signing these documents can take additional time if executors live interstate or overseas.
3. Supreme Court Processing (4-8 Weeks)
Once the documents are filed and the filing fee is paid, the application sits in the Supreme Court Registry queue.
- Current State: Depending on the volume of applications, the Registry usually takes 4 to 6 weeks to review and seal the Grant.
- “Requisitions”: If the Will is damaged, contains staples marks, or the affidavits have typos, the Court will issue a “requisition” demand for more info, which can add 2-4 weeks to the timeline.
4. Releasing the Assets (Post-Probate)
Once the Grant of Probate is issued (a physical document with a court seal), the Executor must send certified copies to banks, share registries, and Titles Queensland.
- Banks: Usually release funds within 5-10 business days of receiving the Grant.
- Property: Transferring a title can take 2-4 weeks through Titles Queensland.
