When do I need to register a Power of Attorney?

A common point of confusion is whether an Enduring Power of Attorney (EPOA) or General Power of Attorney (POA) needs to be “registered” to be valid.

The Short Answer

The document is legally valid the moment it is correctly signed and witnessed. However, it may need to be registered with the Queensland Land Titles Office to be effective for certain transactions.

When Registration is Required

You must register the POA/EPOA if your Attorney needs to:

  • Sell your residential home or investment property.
  • Purchase real estate in your name.
  • Transfer property or sign a mortgage document.
  • Sign any document that must be lodged with the Land Registry.

When Registration is Usually Not Required

Registration is typically not required for:

  • Banking: Most banks just require a certified copy of the EPOA for their internal records.
  • Health Decisions: Hospitals and doctors rely on the document itself.
  • Government Agencies: Centrelink and the Australian Taxation Office (ATO) have their own processes for recognising Attorneys.
  • Personal Matters: Decisions about where you live or what aged care facility you enter.

The Registration Process

Registration involves lodging the original document (or a Title Office sanctioned copy) with the Land Titles Office along with a Form 16. There is a government filing fee associated with this.
