AI tools regularly fabricate case citations. Relying on fake cases in court can lead to professional misconduct for lawyers or contempt of court for litigants.
Artificial Intelligence models are sophisticated text predictors, not legal databases. They often “hallucinate” or confidently invent court cases, legislation, and legal facts that do not exist.
The Dangers of Unverified Citations
In late 2025, three Australian lawyers were referred to regulators for submitting AI-generated documents containing fake citations. The Federal Court now explicitly requires all practitioners and self-represented litigants to verify AI-generated authorities independently before relying on them.
Verification is Mandatory
Never submit a case citation to a court without first verifying it on a trusted database like AustLII. Presenting a fabricated case misleads the court, carrying severe penalties including adverse cost orders and potential contempt proceedings.
