Is a New South Wales Power of Attorney valid in Queensland?
Enduring Power of AttorneyIf you have moved to Queensland or spend significant time here, you might be wondering whether your New South Wales Enduring Power of Attorney (EPOA) is still legally binding.
The short answer is yes. In Australia, legal practitioners and their documents are generally nationally recognized. An Enduring Power of Attorney signed validly in New South Wales, or any other Australian state, can be relied upon in Queensland.
However, there are a few important caveats you must be aware of.
Key Differences Between NSW and QLD
While your EPOA is legally valid, the scope of what it covers depends on where it was drafted:
- Queensland EPOAs: Cover both financial matters and personal/health matters.
- New South Wales EPOAs: Only cover financial matters. To appoint someone to make health and personal decisions in NSW, you must execute a separate document called an Enduring Guardian.
This means if you move to Queensland with only a NSW Enduring Power of Attorney, you have effectively protected your finances, but you have left your health and medical decisions vulnerable. In Queensland, medical decisions can only be handled by an attorney if expressly authorized, or otherwise it falls to the Public Trustee or a QCAT-appointed tribunal member.
Do I Need to Redo My Power of Attorney?
If your document appears valid and correctly executed, it doesn’t need to be changed immediately. However, we recommend reviewing your estate planning documents every five years or whenever there is a major life change (such as a permanent move interstate).
If you have a NSW EPOA but no Enduring Guardian, you should heavily consider executing a new Queensland EPOA so that your health and personal matters are fully covered under a single, localized document. Furthermore, older documents (e.g., drafted 20+ years ago) can use outdated language that might cause banks to hesitate or demand further legal checks.
