Who Owns Copyright in Influencer and Sponsored Content?

Content Ownership

The creator usually owns original content they create. Payment alone does not transfer copyright. The critical question is not only who owns it, but who can use it, where, for how long, in what format and for which commercial purpose.

Payment is not assignment

Under the Copyright Act 1968 (Cth), copyright vests in the author at the moment of creation. A brand paying for a sponsored post does not automatically receive copyright ownership, exclusive licence, or broad reuse rights. Transfer requires a written assignment signed by the creator. What should creators and brands negotiate

A creator agreement should clearly cover:

  • Fee and deliverables
  • Usage rights, territory and duration
  • Paid boosting, whitelisting and edits
  • Approval rights and exclusivity
  • Attribution and takedown provisions
  • What happens if a platform claim blocks the work

Brand reuse in paid advertising

A brand should have clear written rights before using creator content in paid advertising, on websites, in email campaigns, in-store displays or international campaigns. Organic social permission does not necessarily cover paid media or perpetual reuse.

Employee vs contractor ownership

Employment and contractor arrangements can have different copyright results. An employee creating content in the course of employment is subject to different default ownership rules than a contractor. The specific agreement and circumstances determine the result.
