An appeal challenges a decision. A stay temporarily suspends the operation or enforcement addressed by the stay order.
The two should not be confused.1
No automatic pause
Federal Court Rule 36.08 provides that an appeal does not itself operate as a stay or invalidate proceedings already taken.
A party seeking a pause must identify the appropriate application and obtain an order.
Until then, an existing obligation is not suspended merely because it is disputed on appeal.
Check the original commencement
An order may already provide for later commencement.
In the Apple case, the principal changes are scheduled for March 2027, while the judgment treats the Epic-app readmission requirement separately.
That built-in implementation period is not the same as an appeal stay.2
Read the subsequent order
A stay can have a defined scope, duration and conditions.
For any particular case, check the actual sealed order rather than relying on “appeal pending” in a headline.
Appeal requirements also differ between final and interlocutory decisions. Obtain advice promptly rather than assuming every decision has the same pathway or filing deadline.
