How do I apply for a Work Licence?

Driving Offences

A Restricted Work Licence (Section 87) allows you to drive for work purposes while your normal licence is disqualified due to a low-range drink driving or drug driving charge.

The Strict Application Process

  1. Timing is Everything: You must lodge your application and supporting affidavits with the Magistrates Court before you enter a plea of guilty or are convicted. If the Magistrate convicts you first, you are permanently barred from applying.
  2. Supporting Affidavits: You must file an affidavit detailing your extreme financial hardship if your licence is lost, and an affidavit from your employer confirming that you will be terminated if you lose your licence.
  3. Court Hearing: A Magistrate will hear evidence and determine if you are a ‘fit and proper person’ to hold a restricted licence.

Because the rules are unforgiving, you should engage a traffic lawyer immediately.
