Receiving a speeding fine does not mean you are automatically guilty. If you believe the infringement was issued in error, you have 28 days to elect to go to court.
Grounds for Disputing a Fine
You might successfully challenge a fine if:
- You Were Not Driving: You must submit a statutory declaration nominating the actual driver to transfer the fine.
- Calibration Issues: Speed cameras and radar guns must adhere to strict calibration schedules and operational procedures. If police fail to follow the device manual, the evidence may be inadmissible.
- Identity Discrepancies: The photographic evidence is unclear or captures multiple vehicles.
The Warning
If you elect to go to court and lose, the Magistrate can impose a significantly higher fine than the original ticket, and you will be liable for court costs and the Offender Levy. We strongly recommend getting legal advice before contesting.
