Which court hears my civil dispute on the Gold Coast?

The court that hears your civil dispute depends on the monetary value of your claim. In Queensland, the court hierarchy is strictly divided by financial thresholds as at March 2026:

1. QCAT (Queensland Civil and Administrative Tribunal)

Jurisdiction: Minor civil disputes up to $25,000.1 This includes most debt recovery, residential tenancy, and small claims. Applications on the Gold Coast are lodged through the Southport Magistrates Court registry. Legal representation is not permitted as of right for minor civil disputes.

2. Magistrates Court

Jurisdiction: Civil claims from $25,001 to $150,000.2 This captures many contract disputes, commercial debts, and property damage matters. These cases are heard at the Southport courthouse by a Magistrate.

3. District Court

Jurisdiction: Civil claims from $150,001 to approximately $750,000.3 The District Court of Queensland (Gold Coast) is located at Southport. It also hears appeals from the Magistrates Court.

4. Supreme Court

Jurisdiction: Claims above $750,000 and complex legal matters. The Supreme Court is located in Brisbane. Most very high-value Gold Coast matters are commenced here.

Choosing the Correct Jurisdiction

Filing in the wrong court is a costly mistake. If you file a claim in a higher court that should have been heard in a lower court, you may be penalized on costs (meaning you may only recover a fraction of your legal fees even if you win).
