Can police impound my car for speeding?
Driving OffencesQueensland has some of the toughest anti-hooning legislation in Australia.
Police hold the power to impound or immobilize your vehicle if you are caught committing a Type 1 or Type 2 hooning offence.
- Type 1 Offences: Evading police, participating in unlawful speed trials, dangerous operation of a vehicle. A first offence can result in your car being impounded for 90 days.
- Type 2 Offences: Driving an illegally modified vehicle, driving unregistered/uninsured, or driving while disqualified/unlicensed.
Repeated Offences
If you commit subsequent Type 1 offences, the police can secure a court order to have your vehicle permanently forfeited to the state, where it may be sold at auction or crushed. You must also pay the towing and storage fees before getting your car back.
