What is the penalty for Dangerous Driving?
Driving OffencesUnlike standard traffic infringements, ‘Dangerous Operation of a Motor Vehicle’ is a serious criminal charge under the Queensland Criminal Code.
The Penalties
The penalties escalate dramatically depending on the circumstances:
- Basic Offence: Up to 3 years imprisonment and a mandatory minimum 6-month licence disqualification.
- Aggravating Factors: If you were intoxicated (by drugs or alcohol), taking part in an unlawful speed trial, or had prior convictions, the maximum penalty increases to 5 years imprisonment.
- Death or Grievous Bodily Harm (GBH): If your dangerous driving caused death or GBH, the maximum is 10 years imprisonment. If you were also intoxicated or speeding excessively while causing death/GBH, the maximum becomes 14 years imprisonment.
