What is the penalty for failing to remain at an accident?
Driving OffencesUnder the Transport Operations (Road Use Management) Act, if you are involved in a traffic incident on a road, you are legally obligated to stop immediately, remain at the scene, and provide particulars.
If you fail to fulfill these duties (commonly known as a “Hit and Run”), the penalties depend on the severity of the crash:
- Property Damage Only: Fines up to 20 penalty units, potential discretionary disqualification, and up to 1 year imprisonment.
- Injury Incidents: If you flee the scene knowing someone is injured, the maximum penalty increases to 3 years imprisonment.
- Death or Grievous Bodily Harm (Callous Disregard): If you fail to remain and render assistance after causing death or GBH, it constitutes serious criminal neglect. Maximum penalties escalate to 10 years imprisonment (or 14 years in aggravating circumstances) with severe mandatory disqualifications.
