The Charge Matters
- Driving with a Relevant Drug Present: If a roadside saliva test or blood test detects THC, MDMA, or Methylamphetamine, the minimum disqualification is typically 1 to 9 months for a first offence.
- Driving Under the Influence of a Drug (DUI): If police assess your driving as impaired by a drug (including prescription medication), the mandatory minimum disqualification increases to 6 months.
Work Licence Eligibility
Crucially, if you are charged with Driving with a Relevant Drug Present (and not DUI), you may be eligible to apply for a Section 87 Restricted Work Licence if losing your licence will cause extreme financial hardship. You must apply before you plead guilty.
