What is QCAT and how do I apply on the Gold Coast?

The Queensland Civil and Administrative Tribunal (QCAT) is a lower-cost, less-formal venue for resolving everyday legal disputes.

Important Notice for Gold Coast Residents

QCAT does not have a separate, dedicated office on the Gold Coast. All QCAT applications for Gold Coast residents and businesses are lodged at the Southport Magistrates Court registry located at the corner of Davenport and Hinze Streets.

What QCAT Handles

QCAT has jurisdiction over the following categories of legal dispute (up to the value of $25,000 for monetary claims):

  1. Minor Civil Disputes: Unpaid debts, consumer and trader disputes, property damage, and simple contract disputes. (Consumer disputes currently average 1 year).
  2. Residential Tenancy Disputes: Bond claims, compensation, and termination orders between landlords and tenants. (Currently averaging 28 weeks).
  3. Building Disputes: Disputes between homeowners and licensed contractors. (Currently averaging nearly two years).
  4. Retail Shop Lease Disputes: Matters between retail tenants and landlords.
  5. Administrative Review: Applications to review decisions made by Queensland Government agencies.

How to Apply

To start a QCAT application on the Gold Coast:

  1. Download the correct application form from qcat.qld.gov.au.
  2. Complete the form and attach all supporting evidence (such as invoices or contracts).
  3. Lodge the form at the Southport Magistrates Court registry.
  4. Pay the applicable filing fee (which varies depending on the type and value of the dispute).

For minor civil disputes, parties are expected to represent themselves. Legal representation is not permitted as of right; you must obtain the tribunal’s leave (permission) to be represented by a lawyer. Leave is typically only granted in complex cases or where one party would be at a significant disadvantage otherwise.
